PRIVACY POLICY

The following statement describes the privacy policy relating to the muttles.com website (the "Site") operated by MUTTLES LLC (“MUTTLES” or "we"). The purpose of this Privacy Policy is to inform you of the following:

  • What kind of information, including any personally identifiable information, is collected;
  • Who collects the information;
  • How the information is used;
  • With whom the information may be shared;
  • What choices are available to you regarding its collection, use, and distribution;
  • The security procedures that are in place to protect the information; and
  • How you can correct inaccuracies in the information.

Information We Collect

Non-Personally Identifiable Information. Non-personally identifiable information is information that, by itself, cannot be tracked to a specific individual. MUTTLES may collect non-personally identifiable information while you are visiting the Site. While providing services and features, MUTTLES may collect web surfing data such as your IP address, web pages on the Site that have you visited, time and date, the web site you came through to reach the Site, and whether or not you clicked on any links while at the Site.

Links to third parties may be displayed on the Site. If you choose to click on a link, MUTTLES may provide non-personally identifiable information to the third party. Also, the third party may use cookies or other technologies to collect information when you are visiting their web sites. The information advertisers or other third parties collect is governed by their individual privacy policies, not by MUTTLES's privacy policy. You should always ask for your parent’s permission before visiting any new website.

Personally Identifiable Information.
If you are under the age of 13, MUTTLES requires a parent's or guardian's permission before we can collect your personal information. See NOTE TO PARENTS below for more information.
MUTTLES does not collect personally identifiable information (name, address, gender, age, phone) in order to become a registered USER of the Site. If you choose to register at the Site, you will be asked to provide your email address (or your parents’ email address if you are under 13), and to select passwords, usernames, and a location from name choices that we provide. However, while providing other services or features, we may ask you to provide personal information. For example, if you choose to fill out online surveys, participate in contests, events or promotions, you may elect to provide information such as your gender, age, name, telephone number or address. If you are under 13 you will be required to get parent’s permission and /or provide an email address so that we can notify your parents or guardians of your request to participate and provide them with the opportunity to “opt out” and delete your entry and/or account. At the conclusion of the promotion, contest, event or survey, this information will be deleted from MUTTLES database and will in no case be distributed to a third party.

Use of the Information We Collect

Use of Non-Personally Identifiable Information. MUTTLES may use non-personally identifiable information collected to improve the quality of MUTTLES' services; for example, by diagnosing service or technology problems or by assessing and maintaining security.

We may use non-personally identifiable information collected to determine user demographics, interests, and behavior and may market MUTTLES products by sharing non-personally identifiable information with potential customers or partners. MUTTLES also may provide your non-personally identifiable information to contractors so that they can perform services for us. We may also utilize service providers to assist us in aggregating customer information. We may then share such aggregated non-personally identifiable information with prospective marketing partners, advertisers and others.

Use of Personally Identifiable Information. Other Sharing of Information.
We may release any information about any user, including personally identifiable information, if in our sole discretion, release is appropriate to comply with the law, requests or orders from law enforcement, court order, or any investigation. We also may release information to protect our rights, property, or other interests, including those of its customers or users or to prevent illegal activities or violations of the MUTTLES Terms of Service Agreement (available at www.muttles.com/legal).

In the event that MUTTLES, in whole or in part, establishes a partnership with another company, or is acquired by or merged with another company or enters bankruptcy, collected information may be transferred to the partner or the acquiring or merging company.

Notifications/Opt-out. It is MUTTLES’ policy to provide notifications, whether such notifications are required by law or for other business related purposes, to Users via email notice, written or hard copy notice, or through conspicuous posting of such notice on the Site, as determined by MUTTLES in its sole discretion. MUTTLES reserves the right to determine the form and means of providing notifications to our Users. By providing MUTTLES your email address you consent to our using the email address to send you notices, including among other things notices required by law, in lieu of postal mail. You may not opt out of certain product announcements. We may also use your email address to send you other messages, including changes to MUTTLES features and special offers. If you do not want to receive such email messages, you may opt out by cancelling your account with muttles.com and you will no longer have access to your account.

Child Protection

If you are under the age of 13, MUTTLES requires a parent's or guardian's permission before we can collect your personal information. We do this by asking for your parent or guardian's email address. We will send your parents an email notification when you register allowing them to opt-out if they do not wish to give their permission for participation. More information on the process we use is described below in the NOTE TO PARENTS.

International Users

The Site is hosted in the United States. If you are accessing the Site from outside the United States, the laws or regulations governing personal data collection, use, and disclosure may differ from United States laws. Be advised that through your continued use of the Site, which is governed by U.S. law, this privacy policy, and our Terms of Services, you are transferring your personal information to the United States and you consent to that transfer.

Security

MUTTLES makes efforts to protect against the loss, misuse, and alteration of the collected information. Be aware, however, that the Internet is not 100% secure. Therefore, we cannot ensure the security of any information transmitted over the Internet, and we accept no liability for any disclosure. Many areas of the Site are password-protected. To increase the security of the Site, please do not share your passwords with anyone.

Applicable Law. This Agreement and any dispute to this Agreement will be resolved in accordance with the laws of the State of Washington.

Links to Other Web Sites

The Site may contain links to other web sites. In addition, User Submissions might contain links to other web sites. MUTTLES is not responsible for the privacy practices or the content of any third party web sites that may be linked to the Site.

Modifications

We reserve the right to modify this privacy policy at any time by posting the changes on this web page and any such changes are immediately effective upon posting. We also may notify you about changes to the privacy policy by sending you a notice to your email address or by placing a notice on the Site. Please check the effective date at the top of this page to determine if the privacy policy has been modified since you last reviewed it. Your continued use of the Site following posting of this or any updated privacy policy will constitute your acceptance.

NOTE TO PARENTS

The purpose of this Privacy Policy is to provide our visitors with information about our website, which we hope will promote informed choices and decisions about how to use the site, as well as protect our Users' privacy.

MUTTLES recognizes that some younger visitors may not understand some of the information contained on our website or how the site operates. Please discuss this statement with your children so that they will better understand how to use the site and the information they may be asked to provide.

MUTTLES will collect personal information from children under the age of 13 only with parental permission. We make every attempt to inform your children of this policy wherever this information is collected. However, please note that we do not have the internal mechanisms to confirm the accuracy of the statements they provide to us.

MUTTLES will not require a child to disclose any personal information to register and participate on the site. If they are under 13 years of age, they are required to provide a parents’ email address, and a notification will be sent to you along with their User names and passwords.

Because MUTTLES does not share personal information collected by our website users with third parties, we are able to obtain consent from parents or guardians through email. When a child under the age of 13 registers for a contest, survey, or website membership, we will send an email to parents. Parents will be given 48 hours to refuse their child's registration. If the parent refuses membership, we will delete your child's information from our database. If we get permission or if we don't hear back in 48 hours, we will assume it's acceptable for your child to be registered on our site. Once we get permission, we will assume that it is alright for a child to participate in any activity associated with the Site.

Permission for some of our websites may include permitting your child to submit photographs to our website. Please read our Terms of Service for more information on the content and materials that MUTTLES allows to be posted on our websites.

If you suspect that your child has offered personal information in error and/or you wish us to remove their profile from our database, we are happy to do so.
